Battle Mountain Band Election Date
BATTLE MOUNTAIN BAND - The Battle Mountain Band will have an election on June 30 for the empty Band Council seat. Battle Mountain Band Council has consisted of only 6 council members since Edith Tybo vacated the position in March.

ELKO BAND - The Elko Daily Free Press has the article Heller introduces Elko land bill which begins "U.S. Rep. Dean Heller, R-Nev., introduced his House version of a bill to provide land for an Elko motocross park and land for the Te-Moak Tribe of Western Shoshone."

Elko Motocross and Tribal Conveyance Act Introduced to House
ELKO BAND – Wednesday, Rep. Dean Heller introduced H.R. 5416, the Elko Motocross and Tribal Conveyance Act, to the House of Representatives and it was referred to the House Committee on Natural Resources. The bill requires the Secretary of the Interior to convey certain Federal land to Elko County, Nevada, and to take land into trust for the Te-moak Tribe of Western Shoshone Indians of Nevada, and for other purposes. Actions of the Te-Moak Housing Board of May 20
TEMOAK TRIBE – The following actions were made by the housing board on May 20.
- The housing board tabled the personnel policy amendment.
- The types of criminal history allowable for admissions was on the agenda for discussion and concerns were raised on what “lesser crime” meant for housing applicants. When adopted by the board, “lesser crime” would apply to persons submitting applications for housing.
-The 2010 IHP was discussed to inform the housing board of the draft Indian Housing Plan. It was reported that the IHP would be completed before the deadline of June 30.
-The housing board tabled the vehicle purchase by the Client Service Department
-The housing board passed a resolution add Craig Roa and Gilbert Temoke as checksigners for housing.
-The housing board tabled the Field Foreman job announcement
-The housing board tabled the Client Service Supervisor job announcement.
-The housing board voted for Gilbert Temoke to go to housing training.

Flawed Questionnaires
TEMOAK TRIBE – As reported earlier, the Te-Moak Tribe had issued a questionnaire that asked members "should the Te-Moak Tribe of Western Shoshone Tribal Council serve as Te-Moak Housing Authority Board or establish a new Board?”
Unfortunately, the questionnaire was set as a "yes or no" question which led to confusion of tribal members on how to answer the flyer.
Now, tribal members are being asked to circle one of the choices rather than answer yes or no. Also, a new questionnaire is being developed.
If there are further questions regarding the flyer, call (775) 738-9251. Questionnaires can be picked up at the tribal office and should be submitted to the Te-Moak Tribe administration office by May 28, 2010.

Band Council Takes Back Assignments
SOUTH FORK BAND – It is being reported that the South Fork Band Council has begun the process to take assignments away from two tribal members. In a decision by the Council earlier this week, the Band Council has taken action against the tribal members. Because the Band Council meeting was closed, there is no information of who the two tribal members are.

Barrick's Offer To Tribes
TEMOAK TRIBE - As reported earlier, the Elko Daily Free Press has the article Barrick hosts thank-you tour which reported “a number of the Te-Moak tribal members weren’t aware the tribal council rejected Barrick’s offer for a collaborative process that would have provided $5,000 scholarships for students, $1 million toward senior facilities and included two South Ruby ranches. The offer was in lieu of Te-Moak continuing the lawsuit against the project.”
In a letter from Gregory A. Lang, Barrick Gold of North America President, the offer reported in the Free Press was contingent upon certain concessions of the Tribes.

Wells Band Awarded ICDBG Funds
WELLS BAND – The Wells Band was awarded $605,000 in Indian Community Development Block Grant (ICDBG) Program funds. The award funding is for the project of a community building at the Wells Indian Colony.

Tribe Issues Another Questionnaire
TEMOAK TRIBE – Once again the Te-Moak Tribe has issued a questionnaire to the members of the Tribe. The Tribal Council wishes input from the public about supervisory board of the Tribe’s housing authority.
Currently, the Tribal Council doubles as the supervisory board for the housing authority.
The only question on the flyer is “should the Te-Moak Tribe of Western Shoshone Tribal Council serve as Te-Moak Housing Authority Board or establish a new Board?”

Tribe Court Hearings Begin Again
TEMOAK TRIBE – The Court for the Te-Moak Tribe began hearing cases again today. The last time the court held hearings was March 5.
Judge Bill Kockenmeister presided over approximately 46 cases today ranging from arraignments to trials. News of today’s court cases will be posted at a later date.
The court stopped hearing cases due to the lack of funding to pay the salary of the judge. The Bureau of Indian Affairs paid for the salary of the judge but ran out of funds in March. It was reported at the last Tribal Council meeting that the BIA did have funding for the salary of the judge but then reallocated those funds to another Indian tribe without informing the Te-Moak Tribe.
The next court hearing is scheduled for Friday, May 28.

Band Council Eyes Absent Assignment Holders
SOUTH FORK BAND – The South Fork Band Council is addressing absent assignment holders at the South Fork Indian reservation. Assignments are parcels of land within the reservation that are leased to and utilized by tribal members for homes and to make a living, usually by means of ranching. Currently, there are tribal members who lease assignments and no longer reside on the South Fork reservation. As the Band Council continues to take up this issue, the number of absent assignment holders is unknown.

US Forest Service Publishes DEIS
TEMOAK TRIBE - The US Forest Service has published the Draft Environmental Impact Statement (DEIS) for the Combined Travel Management Project. The project will revise the travel management plans for the Mountain City, Ruby Mountains, and Jarbidge Ranger Districts to reasonably accommodate the needs of the recreating public, access for mineral exploration, and access for livestock management. Hard copies of the DEIS and maps are available for viewing at Te-Moak Tribal offices in Elko, Nevada.

Band Council Member At Museum Archeology Fair
ELKO BAND - The Elko Daily Free Press has the article Museum Hosts Archeology Fair which reports “At a table nearby, a collection of seeds, dried berries, pinenuts and the tools with which American Indians ground them up to make products like biscuits were on display. “It helps introduce people to how we lived,” said Evelyn Temoke-Roche, vice chairwoman of Te-Moak Tribe of Western Shoshone Elko Band Council.”

ELKO BAND - The Elko Daily Free Press has this posted, “May 7. Franklin Lee Harrington, 24, Spring Creek. Ruby View Drive and Indian View Heights. Tribal charge of assault; $500.” The charge listed does not imply guilt. Under the law, everyone is presumed innocent unless proven guilty in court.

TEMOAK TRIBE – The Te-Moak Tribal Council continues to review the proposed Banishment Ordinance and will send to all Band Councils a legal opinion of the proposed ordinance for their review. The proposed Banishment Ordinance will give the Tribe authority to remove tribal members from its jurisdiction.
Tribe Continues to Mull Tribal IDs
TEMOAK TRIBE – The Te-Moak Tribal Council continues to review the possible issuance of new tribal identifications cards, this time sending out a survey to tribal members. At a previous Council meeting the Tribal Council decided to post flyers seeking input of tribal members of what information should be put on the identification cards. Comments received were that the Tribe should not put social security numbers on the IDs. With the new decision of the Tribal Council to issue a survey to tribal members, the process of issuing tribal cards will continue.

Update: Tribe's Court Prepares for Hearings
TEMOAK TRIBE - The court for the Te-Moak Tribe will begin to hear cases beginning Monday, May 17. The Court was shut down in March when the Bureau of Indian Affairs ran out of funds to pay for the salary of Judge Bill Kockenmeister. Further, it is being reported that at one time the BIA did have funding for the salary of the judge, but then reallocated those funds to another Indian tribe without informing the Te-Moak Tribe.

Tribe's Court Prepares for Hearings
TEMOAK TRIBE - The Te-Moak Tribe's court will resume hearing cases. Previously, the Tribe's court suspended proceedings in all cases since the Bureau of Indian Affairs ran out of funding to pay Judge William Kockenmiester in March.

-Myron Tybo’s Horses – what will be done with the horses, also letter of request for SFBC equipment that Myron has in his possession.

Battle Mountain Band Council Position Remains Vacant
BATTLE MOUNTAIN BAND - Since Edith Tybo vacated her position in March as a councilmember on the Battle Mountain Band Council, her position still remains empty. The Band Council and Election Committee have not started to fill the position despite the Tribe's Constitution requiring that an election be conducted in 30 days. Although members of Battle Mountain continue to question the inaction of the Band Council, the Council doesn't show any signs to fill the vacancy.

Reid Statement on Elko Motocross and Tribal Conveyance Act
TEMOAK TRIBE - The statement of Senator Reid on behalf of the Te-Moak Tribe and Elko Band for the Elko Motocross and Tribal Conveyance reads, "The Elko Band have been an important part of the Elko Community since it was established in the late 1800s. In spite of a steadily growing population, the colony has not expanded for 75 years and most members of the Elko Band have to make their homes outside of the colony. As you know, land is lifeblood for Native Americans. It is a place to make a home and earn a living, a place tied to ancestors, and key in the preservation of culture and language. My legislation provides space for appropriate residential and commercial development, as well as for traditional uses, such as ceremonial gatherings and plant collecting."
