Federal Court Gets Tough; Rejects Jones Plea Agreement

     TEMOAK TRIBE - On October 18, Federal District Court Judge Robert C. Jones rejected the plea agreement and guilty plea of Terry Dale Jones Jr.
     On January 6, Jones was indicted by the federal grand jury with a federal charge of assault with a dangerous weapon in regards to a stabbing in November 2009 on the upper Elko Indian Colony.
     A plea agreement was reached between the prosecution and the defense in July.  If accepted by the court, the agreement stipulated that Jones would receive 18 months of incarceration with credit for time served, 3 years probation, and that Jones would not be able to enter the Elko Indian Colony for any reason.
     At the October 18 hearing before Judge Jones, the agreement was presented and rejected by the Court citing the leniency of the sentencing and set the case for trial.
     The Court ordered that the jury selection is scheduled for January 19, 2011 at 9:00 a.m. in Elko, Nevada.  The jury trial is scheduled for January 24, 2011 at 8:30 a.m. in Reno Courtroom 6 before Judge Jones.
     A motion hearing is scheduled for Monday, November 15, 2010 at 3:00 p.m. in Reno Courtroom 6 before Judge Jones
     Terry Dale Jones Jr. was remanded into custody after the October 18 hearing.
