Fed Failure - Motion To Dismiss In Terry Jones Jr. Criminal Case

     TEMOAK TRIBE - Assistant US Attorney Sue Fahami submitted a motion to dismiss the federal criminal case against Terry Jones, Jr.
     Fahami cited in her Nov. 30 pleading that the US Attorney's office is dismissing "in light of the Elko Tribe's decision to exercise jurisdiction over this case and prosecute the defendant in CFR/Tribal Court."
     Federal district court judge Robert C. Jones has set a hearing date of Dec. 7 to hear the motion.
     On January 6, Jones was indicted by the federal grand jury with a federal charge of assault with a dangerous weapon in regards to a stabbing in November 2009 on the upper Elko Indian Colony.
