TEMOAK TRIBE - On September 22, a federal charge of misdemeanor assault resulting in serious bodily injury was filed in Nevada Federal District Court against Vivian Marie Potter for an incident that occurred on the Elko Indian Colony.
According to the indictment, Potter struck the victim, an Indian, several times with an aluminum bat causing a fracture and permanent nerve damage. The incident occurred on or about January 10, 2010.
Potter pleaded not guilty and the jury trial is set for December 7.
